General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all orders placed through the online shop of Holz&Gefühl, Unterm Berg 6, 4565 Inzersdorf, Austria (hereinafter "Provider"), at holzundgefuehl.at. Deviating conditions of the buyer are not recognized unless the Provider expressly agrees to their validity in writing.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By submitting an order, the customer makes a binding offer to purchase. The Provider confirms receipt of the order by email. The purchase contract is only concluded with the express acceptance of the order or the dispatch of the goods.

3. Prices and Payment

All prices in the online shop are stated in Euro (EUR) and include statutory value-added tax. Shipping costs are shown separately at checkout. The Provider reserves the right to change prices at any time. The price valid at the time of the order is decisive. Payment is made using the payment methods offered in the shop.

4. Delivery

Delivery is made to the delivery address specified by the customer. Delivery times and shipping costs are regulated in our Shipping Policy. The Provider is not responsible for delays caused by the shipping service provider or circumstances beyond the Provider's control.

5. Retention of Title

The delivered goods remain the property of the Provider until full payment of the purchase price.

6. Right of Withdrawal & Returns

The provisions of our Return & Refund Policy and the statutory regulations of the Austrian Distance and Off-Premises Contracts Act (FAGG) apply.

7. Warranty

The statutory warranty rights according to Austrian law apply. The warranty period is two years from the handover of the goods. In the event of detected defects, please contact us at holzundgefuehl@proton.me.

8. Limitation of Liability

The Provider is not liable for damages resulting from improper use of the products. Liability for slight negligence is excluded, as far as legally permissible. This does not apply to personal injury or claims under the Product Liability Act.

9. Intellectual Property

All content of this online shop, including texts, images, graphics, and logos, is protected by copyright and is the property of Holz&Gefühl. Any reproduction or use without express written permission is not permitted.

11. Applicable Law & Place of Jurisdiction

Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance and jurisdiction is, as far as legally permissible, the Provider's registered office in Austria. For consumers within the EU, the mandatory consumer protection regulations of the respective country of residence also apply.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which can be found at https://ec.europa.eu/consumers/odr. We are not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.
